I have a query. Is is required under law to give notice to the other side before filing the Consumer Complaint or I can file a Complaint directly without issuance of notice?
Statutorily under law, you are not required to issue notice and its not compulsory. However, it is always advisable to issue notice and bring to notice the deficiency on part of other side and even after that, if the issue is not resolved, the Complaint should be filed. In many cases, the other side is unaware about the issue and when it brought to their notice, the same gets resolved. However, it is not compulsory and there may be cases when it may not be even feasible to do so and you may directly file the Complaint.
